Peak Accountancy Policies
Terms and conditions
These terms and conditions together with the booking form comprise the agreement pursuant to which Peak Accountancy Training provides classroom and online courses and associated study material to the customer.
1. Payment
For all courses and exams, bookings are all to be made using our online booking system. If the booking is from an individual payment must be made by card at the time of purchase. If your employer is funding the courses and/or exams then the employers billing information must be provided together with any required Purchase Order number. Invoice terms are strictly 30 days for courses and the earlier of 5 days or the day prior to the exam date for exams.
If full payment is not received according to payment terms then Peak reserve the right to terminate the course or in the case of an exam to refuse the student entry to the exam room and to cancel the exam.
Peak Accountancy Training reserves the right to charge late payment interest on any invoices not paid within the terms applied at a rate of 8% above the Bank of England base rate.
Peak Accountancy Training reserves the right to recover any reasonable debt collection costs in connection with this Agreement.
If the employer gives authorisation to be invoiced the employer is liable for all unpaid invoices even if the student leaves their employment before, during or after the course.
Any credit notes issued will be valid for 12 months from date of issue.
2. Booking and Registration
It is the responsibility of the person making the booking to ensure that the selected courses are appropriate for their needs.
Any change in the customers’ contact details must be notified in writing.
Peak Accountancy Training does not accept responsibility for registering customers with professional bodies for the relevant exams.
Courses and study materials are not transferrable between customers.
3. Classroom Courses
Students must bring their joining instructions on the first day of the classroom courses. Failure to bring them may lead to them being refused entry to the building and the classroom course.
Study materials will be issued on the first day of the classroom course.
Peak Accountancy Training reserves the right to cancel, reschedule, or change the location of a course. Peak Accountancy Training will endeavour to let students know as soon as the change is made. In such circumstances, the student has the option to reschedule the course, apply the fees to another course, or to receive a refund or credit note for the course fees paid.
Study material is not transferable between students.
Refunds are only available if the classroom course is cancelled within 14 days of making the original booking and any materials issued are returned undamaged. If materials have been used a deduction will be made for materials. No refunds are available for cancellations made more than 14 days after the original booking date.
All courses must be commenced within 2 years of making the original booking (commencement means having accessed the online resources). Any courses not accessed within 2 years will lapse and a new booking and payment must be made.
4. Live Online Courses
Live Online resources and study support will be provided for a period of 6 months from date of commencement of each unit.
Live Online access may be extended for a further 6 months subject to a re-registration fee of £50.
Live Online study materials may be collected in person or delivered to the customer’s preferred address. Peak Accountancy Training must be notified of any queries, complaints, damage or short deliveries within 14 days of receipt of study materials, if a refund or replacement is required.
Refunds are only available if the live online course is cancelled within 14 days of making the original booking and any materials issued are returned undamaged. If materials have been used a deduction will be made for materials. No refunds are available for cancellations made more than 14 days after the original booking date.

5. Basic Online Courses

6. Security
Whilst at Peak Accountancy Training personal possessions are the sole responsibility of the student and Peak Accountancy Training accepts no responsibility for anything that is lost or stolen. Peak Accountancy Training advise students to keep valuables with them at all times.
7. Notices
Any notices required to be served by Peak Accountancy Training under this Agreement will be deemed properly served if sent via prepaid postage to the postal address, or emailed to the email address notified by the student.
8. Intellectual Property
All intellectual property rights in all materials and online resources supplied by Peak Accountancy Training or their selected partners is expressly reserved. Any unauthorised duplication, publication or distribution is strictly prohibited.
9. Liability
The liability for Peak Accountancy Training and its Directors, Partners and employees for direct losses arising out of their negligence (other than in respect of liability for death or personal injury), breach of contract or any other cause of action arising out of or in connection with this Agreement shall be limited to the cash receipts from the student or employer for the course they are attending at that time.
Peak Accountancy Training and its Directors, Partners and employees shall not be liable for any indirect or consequential loss whether arising from negligence, breach of contract or otherwise.
10. Warranty
Peak Accountancy Training warrants that study materials will be of satisfactory quality but does not warrant that study materials will be error free.
Peak Accountancy Training warrants that it will perform any services under this Agreement with reasonable skill and care.
These warranties are provided in lieu of all other warranties express or implied which are hereby excluded to the fullest extent permitted by law.
11. Data Protection
Students and employers agree that, in relation to information held from time to time, Peak Accountancy Training may use the information to perform their obligations and enforce rights under this Agreement.
Peak Accountancy Training may use the information to inform students about courses, products or services which may be of interest to them and their employers.
Peak Accountancy Training may use the information to inform students of feedback and exam results.
Peak Accountancy Training may communicate with the student’s employer regarding their progress, results and attendance.
Students have the right to receive details of the personal information held by Peak Accountancy Training.
12. Validity
If any provision of this Agreement is held to be invalid or unenforceable by any tribunal of competent jurisdiction, the remaining provisions shall not be affected and shall be carried out as closely as possible according to the original intent.
13. Jurasdiction
The parties to this Agreement irrevocably submit to the exclusive jurisdiction of the English Courts for the determination of disputes arising under this Agreement.
In the event of any inconsistency between the Terms and Conditions on our website and those contained in this document, the latter take precedence.

REFUND POLICY – ONLINE COURSES
Refunds are only available if the online course is cancelled within 14 days of making the original booking and any materials issued are returned undamaged. If materials have been used a deduction will be made for materials. No refunds are available for cancellations made more than 14 days after the original booking date.
It is the customer’s responsibility to ensure that Peak Accountancy Training online resources are capable of being viewed and used on their technology. Refunds will not be given if the materials are not capabale of being viewed or used on their technology.
Online resources and study support are made available for a period of 6 months from the date of commencement of each unit. After 6 months access to the online resources and support will be terminated. Access can be extended for a further 6 months on payment of a reinstatement fee of £50.
REFUND POLICY – EXAMS
It is the responsibility of the student to book their exams with an exam centre – the exam centre may have their own refund policy, and students are advised to check with the appropriate centre.
It is the students responsibility to ensure that the booking is for the correct exam
Exams booked at Peak Accountancy Training must be paid for at the earlier of 5 days from booking or the date prior to the exam. Failure to make payment will result in the student being unable to sit the exam.
No refunds are available once an exam has been booked.
In the event that you need to change your exam date once it has been booked.
This can be done up to 2 weeks prior to the original exam date booking.
You will need to ring Business Operations on 01625-574856 to request the change.
Business Operations will provide a coupon which can be used to book an alternative date and time with a resulting charge of £42 including VAT.
